Court Reverses AT&T Order Seen Harming Consumer Protection


A U.S. appeals court restored regulators’ role in consumer-protection cases against telecommunications companies like AT&T.

The court said the Federal Trade Commission can regulate non-telephone activities by the communications giant, which also owns DirecTV.

The case drew dire warnings from the FTC and the Federal Communications Commission that without a reversal of a 2016 ruling, some telecommunications companies would fall into a regulatory gap where specific business practices could evade oversight, inhibiting consumer-protection cases. AT&T had argued that its activities fall under the supervision of the FCC under an exemption for common carriers like phone companies.

Watch the Newest Ads on TV From Tide, Capital One, Febreze and More


Every weekday, we bring you the Ad Age/iSpot Hot Spots, new TV commercials tracked by iSpot.tv, the real-time TV ad measurement company with attention and conversion analytics from more than seven million smart TVs. The ads here ran on national TV for the first time over the weekend.

A few highlights: Jennifer Garner teams up with Captain Obvious to share news about a partnership between Capital One and Hotels.com. Tide serves another one of its not-what-it-seems-at-first ads; this one appears to be a mattress ad until suddenly it’s a Tide ad. (See Jack Neff’s Feb. 4 post, “Tide is Everywhere With Campaign to Own All Super Bowl Ads,” for background on the brand’s bait-and-switch approach.) And the NBA debuts another ad celebrating the Chinese New Year, this one starring New Orleans Pelicans power forward Anthony Davis (basically a remake of an earlier ad that starred Boston Celtics point guard Kyrie Irving).

FlyGTA, Toronto’s ultra-short haul carrier, has collaborated with Toronto street artists Runt, Jimmy Chiale and Uber5000 to design their air sickness bags. Dubbed Sick Art (#sickart), the limited series will feature three distinct designs, one from each of the artists. The bags will be in FlyGTA’s aircraft starting from March 1st and will be available until they run out, which everyone hopes will not be too soon. In addition, framed air sickness bags will be on permanent display in the FlyGTA lounge at Toronto’s Billy Bishop Airport. The idea was developed and produced by Toronto creative and branding boutique LP/AD. Runt, Uber5000 and Jimmy Chiale are three of Toronto’s more popular and prolific street artists. Their work can be seen adorning the sides of buildings across the downtown core and in Toronto’s Graffiti Alley.

StrawberryFrog Launches Sister Shop BlueberryContent

“The time has come,” the Walrus said, “to talk of many things. Of new biz opps and content shops…”

On that note we turn to StrawberryFrog, which is the latest in the long and surely growing list of agencies that have launched their own internal #content studios.

Some of BlueberryContent’s projects began a while ago, but the branding/ packaging/ publishing/ design unit of Scott Goodson’s agency officially launched today. The new berry in town promises “a fresh and fragrant take on stretchy content,” which is an arrangement of words we’ve yet to hear in that particular order.

“Clients are increasingly looking for content that can be used across digital, social and all platforms. Blueberry Content’s mission is to ignite the most powerful force—a smart design idea that makes a difference in client’s business,” said BlueberryContent’s Karin Drakenberg, who is also both EVP of StrawberryFrog and Goodson’s wife.

A quick glimpse at the new division’s Instagram page reveals a range of projects like packaging design for AB InBev’s Budweiser NEO, logo design for First Abu Dhabi Bank and the No Bullshit cleanser line.

Long-term plans for BlueberryContent and StrawberryFrog aren’t yet clear. The shop, which has been independent for nearly a year since buying itself back from Apco Worldwide last May, recently debuted its first Olympics ad for client SunTrust.
We might point out that the logo does not resemble a blueberry so much as a rolling eyeball. But surely that was intentional.

Apple Is Said to Plan Giant High-End IPhone, and a Lower-Priced Model


Apple is preparing to release a trio of new smartphones later this year: the largest iPhone ever, an upgraded handset the same size as the current iPhone X and a less expensive model with some of the flagship phone’s key features.

With the new lineup, Apple wants to appeal to the growing number of consumers who crave the multitasking attributes of so-called phablets while also catering to those looking for a more affordable version of the iPhone X, according to people familiar with the products.

Apple, which is already running production tests with suppliers, is expected to announce the new phones this fall. The plans could still change, say the people, who requested anonymity to discuss internal planning.

That was the message from the top network-equipment makers when they took the stage at the wireless industry’s annual gathering in Barcelona.

China’s Huawei Technologies, Sweden’s Ericsson and Nokia Oyj from Finland are hoping that the fifth generation of wireless infrastructure will be a much-needed shot in the arm after years of stagnating demand for the gear used to build 2G, 3G and 4G networks. Their message at Mobile World Congress in Barcelona was that 5G is close, with the first commercial networks based on the new technology set to be built later this year.
